Art and Collectibles Policy

This is a binding agreement between you and DealDash Inc and its affiliates including Parke-Bernet (the "Company"). By participating in an auction, winning an auction, or utilizing the "Buy it Now" function (an "Activity") in an auction subject to this Art and Collectibles Policy (a "Covered Auction"), you understand and agree to this Art and Collectibles Policy (the "Policy"). If you do not agree to or understand this Policy or otherwise do not meet the terms of this Policy, DO NOT ENGAGE IN ANY ACTIVITIES ON A COVERED AUCTION. Any Capitalized terms in this Agreement, not otherwise defined herein, will have the terms described in the Terms of Use and references to affiliates include commonly-controlled parties.

  1. Item Condition: The item auctioned is unique and is sold as-is. The Company makes every attempt to procure all items from reputable vendors.

  2. Authenticity Guarantee: The Company provides the original purchaser with a limited guarantee that items in Covered Auctions are authentic and not counterfeit. For purposes of this guarantee, a "counterfeit" means an intentional imitation created to deceive as to authorship or origin, where such imitation is not disclosed in the item description at the time of listing.

    This guarantee does not apply to, and the Company makes no warranty with respect to, errors, omissions, or differences of opinion regarding an item's description, including but not limited to age, date, period, culture, attribution, provenance, or historical classification. Good-faith inaccuracies or subsequent reclassification of an item shall not constitute lack of authenticity or render an item counterfeit.

    This guarantee applies solely to the original purchaser, is non-transferable, and is valid for three (3) years from the auction end date. Should the authenticity of an item be successfully challenged by recognized scholarship within such period, and the Company reasonably determines that the item is a counterfeit, as defined above, the Company will accept return of the item and refund the purchase price and credit the bids used in the auction, which shall be the purchaser's sole and exclusive remedy.

    Except as expressly stated herein, all items are sold as-is and on a final sale basis, and no other warranties, express or implied, are made.

  3. Buy it Now orders: As the item is unique or has unique features, the Company will fulfill "Buy it Now" orders with the following restrictions:

    1. If the auction winner does not redeem the product / exchanges it for bids as offered by the Company, the Company will fulfill the first "Buy it Now" order with the auctioned item.
    2. If the auctioned item is not available to fulfill a "Buy it Now" order, due to the auction winner redeeming the item, and/or there being multiple "Buy it Now" orders, DealDash will offer Buy it Now customers the following choices.
      1. If DealDash is able to immediately, within fourteen (14) days of the auction end date, find an Alternative Piece, from the same artist, manufacturer, or brand, from items exchanged or otherwise retained from prior collections, DealDash reserves the right to offer an Alternative Piece.
        1. The Alternative Piece will have a value between 70% and 100% of the listed "Buy it Now" price, where the value is defined as the estimated value previously assigned to and displayed for that item when it was listed on DealDash.
        2. DEALDASH WILL STRIVE TO OFFER AN ALTERNATIVE PIECE, BUT MAKES NO GUARANTEE. PLEASE NOTE THAT FINDING AN ALTERNATIVE IS VERY UNLIKELY, AND IF YOU "BUY IT NOW" YOU ARE LIKELY TO RECEIVE A SUBSTITUTION OR BIDS AS OUTLINED BELOW.
        3. The customer is not obligated to accept the Alternative Piece, and may opt to receive bids instead as defined below.
      2. If the customer is not satisfied with the substitution, or lack thereof, they will receive the specific bids as provided in (2) below and are not eligible for a refund of their 'Buy it Now' price.
      3. DealDash will offer the customer a quantity of bids, which is outlined in the description of the Covered Auction.

  4. Parke-Bernet: DealDash collaborates with its affiliate, Parke-Bernet, on certain select auctions featuring art and other rare collectibles. The Parke-Bernet brand, formerly America's leading auction house, was revived to provide curated art services. Any such certifications by Parke-Bernet are provided in accordance with DealDash's Authenticity Guarantee.

  5. Arrangement of Shipping: After winning an auction or using the "Buy it Now" function on a Covered Auction, DealDash will reach out to you to arrange shipment of the item, and to present alternatives if applicable (as seen in Section 2). To be able to determine which items are available to ship, shipment will occur fourteen (14) days after the auction end date the earliest. Please note that due to the high value of the item, a custom shipping method may be used, and the customer may be required to receive the shipment in person. DealDash will primarily aim to deliver items to winners, or under Section 2, within thirty days; but due to the unique nature of the items offered, DealDash will reserve the right for longer delivery times.

  6. Returns: Due to the unique, collectible, and often irreplaceable nature of items offered under this Art and Collectibles Policy, DealDash does not accept returns, refunds, exchanges, or cancellations of any items once such items have been shipped to a customer. Notwithstanding any other terms or agreements with DealDash, all items are sold on a final sale basis, except as expressly set forth in this Policy or as required by applicable law.

  7. Indemnification: You understand and agree that a breach of this Policy shall constitute a breach of the Terms of Use, including for the purposes of Section 32 of the Terms (relating to indemnification). DealDash reserves any right to any action allowed under the Terms for any breach of this Policy.

  8. Conflicts: In the event that any statement on DealDash.com or any provision of the Terms of Use or other policy made thereunder contradicts this Policy, to the extent that this Policy is specifically applicable, this Policy shall supersede the statement or provision.
